A Brooklyn man is facing multiple felony charges after authorities say he attempted to rape and rob a man who was already dead, in a chilling incident that unfolded aboard a nearly empty New York City subway train.
The suspect, 44-year-old Felix Rojas, was arrested on April 27 after turning himself in to police — accompanied by his teenage son — just days after the NYPD released surveillance images of the alleged attacker. He now faces charges including attempted rape, grand larceny, and abuse of a corpse.
Caught on Camera: A Crime Beyond Disturbing
According to the criminal complaint filed by NYPD detectives, the incident took place approximately three weeks ago on a southbound R train, during late-night hours when the train car was completely empty.
Security footage shows Rojas boarding the train and encountering an unresponsive man slumped in a seat. Believing the man to be unconscious, Rojas allegedly proceeded to search through his pockets and remove personal items, before attempting to sexually assault the lifeless body.
The victim was later determined by medical examiners to have already been deceased at the time of the assault.
Rojas fled the train shortly afterward, and the victim was discovered when the train reached the Bay Ridge–95th Street station, the final stop on the line.
Suspect Surrenders After Public Appeal
The NYPD released still images from the surveillance footage to the public on April 24. Just three days later, Rojas voluntarily turned himself in at a Brooklyn precinct. He reportedly made no statement during his arrest, and police say he appeared visibly shaken.
During his arraignment, prosecutors described the case as “grotesque,” noting that the act was both criminal and deeply inhumane, regardless of the victim's state at the time.
Rojas is currently held without bail pending further investigation and psychiatric evaluation.
Victim’s Identity Withheld, Cause of Death Unknown
The deceased man's identity has not been made public, pending family notification. Authorities have confirmed that no foul play is suspected in the victim’s death prior to the assault. An official autopsy is underway to determine the exact cause and time of death.

The incident has triggered strong public reaction, with New Yorkers expressing shock and outrage that such a crime could occur unnoticed in the city’s subway system. Transit advocates and city officials are renewing calls for:

Detectives are now examining Rojas’s criminal history, which includes prior arrests for minor offenses. They are also reviewing whether Rojas and the victim may have had any prior contact or whether the encounter was random.
